DWP Employee exercises two minutes of free speech at the Commerce, Energy and Natural Resources Committee

A part time management professor and DWP employee spoke to the Commerce, Energy, and Natural Resources Committee today. Subsequently, Councilwoman Janice Hahn and Committee Chair Tony Cardenas made no comment and took no action other than to adjourn the meeting.

“My name is Daniel N. Shrader, I am an employee of the Department of Water and Power.

I can see the motivation for allowing the Empire contract and more importantly employee retaliation issues to slip under the rug. I am here to ask you to keep them on the agenda and to expand the scope of the motion.

With the exception of one manager, Mahmud Chaudhry, the management of Department of Water and Power has two policies: One, to do nothing and to hold on until their retirement. And two, to actively support Union interests at employee and citizen expense.

If you will notice, employees that speak out against mis-management and conflicts of interest are subject to management-orchestrated retaliation. I have submitted reports reflecting my findings to the Board of Water and Power Commissioners. Assistant General Manager, Henry Martinez, told the Board that he would conduct an investigation and provide his findings in November of 2004. There was no legitimate investigation. Not one person other than the perpetrators cited in the report was contacted. The findings were swept under the rug and the perpetrators were promoted.

On November 9, 2004, I submitted the report and these issues to this committee. Your review of the Empire contract revealed that the Department did not tell you the truth about the matter. You admonished Henry Martinez on integrity. Your talk to Henry Martinez has had no noticeable effect to improve the situation at DWP. Employees are being retaliated against. The public is not best served by these conflicted interests.

You place considerable faith in General Manager, Ronald Deaton. He has been at the DWP for five months – One month less than James Hahn claims to have given Bernard Parks to clean up the LAPD before firing him. In that time, Mr. Deaton has not spoken to the employees, not presented a vision, not stopped management-orchestrated retaliation, nor directed employees in a new direction.

I will tell you that it takes considerable wherewithal to speak up about the problems at DWP. I would think that you would at least pursue the matter fully. The problem is so bad at DWP that only one single Assistant General Manager has shown the backbone to speak to the Mayor. His letter to the Mayor was reported in LA Weekly. It is no surprise that even he is met with silence from the Mayor and the City Council. Your silence and willingness to ignore what is happening at DWP speaks volumes about the conflicts of interest you too suffer.

The management, the Board of Water and Power Commissioners, the City Council, the Mayor, and this committee are the persons charged with steering the events unraveling before us. The main topic of the Mayoral debate was integrity and trust. You found them lacking in Henry Martinez. I find that, too.

Managing a company is a lot like driving a car. You have to look out the windshield and adjust for what you see ahead, and here is the key, you need to take appropriate action to avoid the obstacles or suffer the inevitable collision. The DWP is definitely in trouble. Outside of Mahmud Chaudhry, I don’t see the management, the Board at DWP, the City Council or the Mayor taking appropriate action to address what we all see when we look out the windshield. Los Angeles cannot afford more corruption, mismanagement, and ineffectiveness.

Please do not shelve the motion to investigate the DWP conflict of interests, contract issues, and management-orchestrated
retaliation against employees.”

My brother Daniel Shrader is absolutely correct when he says that DWP Managment is corrup, but not ALL Managers are! There are several honest, decent Managers throghout DWP. They are simply too afraid of retaliation to speak up. I know this because I was one of the very first employees who was retaliated against for having complain about not being properly compensated and for suffering discrimination. My article was the first articule posted on the LA WEEKLY news paper by an active employee. DWP MAnagment does not seem to care because they find one or two employees whom have lied and so, Management hangs their entire so called "investigations" on that one lie. Then Managment claims to have investigated and that they only found smoke screens. Smoke screens my eye! The only persons with Power to create smoke screens is Managment. Who is Managment protecting?
What is it going to take for this City, our Mayor and the City Council to pay attention, an unfortunate event?

Dear Daniel:

Hats off to you dear friend. Full esteem ahead!

I read your articles and I agree with your description of what is happening at DWP. You are a wonderful writer!

Ignorance is bliss. Once you point out what is happening at DWP, it all becomes very clear.

I have a few comments:

1) Incompetence? Is that word equivalent to ignorance? Because if it is, I'm afraid those upper level managers will portray themselves as not knowing what they are doing, they will present themselves as innocent, even though everyone knows they are not. They know exactly what they are doing! Their actions are deceitful, grossly negligent, and reflecting back room politics. You said it best last December, when you said that those managers are seasoned savvy veteran attorneys. Let's not leave them weaseling for public pity.

2) EMPIRE. There's a lot that you do not know about management’s orchestration of the contract and the investigation. You do wonderfully with your awareness, knowledge of management, mismanagement, corruption, and your strong showing of support for your fellow DWP employees. You are a whistle blower, NO DOUBT!

I dare say it is easy to see you have all the qualities which have kept you from going straight to the top of this organization: Knowledge, integrity, conviction, and the strength to articulate them. You should have been representing the public and running the DWP a long time ago. If I were a dishonest person or a hypocrite, like many of those running the City and DWP today, I would hide my face in shame and not dare say a word. This is a different management breed.

But, I really like you and I want nothing other than for you to be successful, healthy, and happy. So you will have to forgive my forwardness.

One, do not be confused. You are not a painter or a carpenter or a roofer. You are a leader, a professor of good management, a wonderful writer, and a loyal public servant. You have become a thorn in the side of the Mayor, the City Council, and present management at DWP and they would like nothing better than to destroy you.

Two, like you, there are a lot of good DWP employees who are behind you ‘almost’ all the way. I know because I know many of them and we talk about you and pray for your success everyday. ‘Almost’ because we simply are afraid to jump in with both feet and articulate our views like you have. But, be assured, we do have our views and they are very supportive of what you are doing. What sets you apart is that you seem to have risen above the lightening and thunder of management’s fear and intimidation and found the sunlight of your own internal strength, dignity, self respect, and moral direction.

I was in the dark about a lot of things. I was unhappy at work and I did not know why. I could not put my finger on what was wrong. Then my coworkers began to complain and put it in my face. It is not money or benefits. I saw the decisions being made were not in the public interest, the collusion between management and the union have become very apparent, and the results are destructive and dysfunctional and have become the focus of everyone’s workday.

Please don't let others sidetrack your objectives to reform the DWP. Like all the other management crimes, the Empire contract evidence is gone. Management’s network and ‘clean up’ crews have done their job. Management will continue to claim the absurd – that we are disgruntled. Stick to your guns. When you describe what management does, their behavior, and the environment management promotes which includes not following procedures and work practices, intimidating witnesses, and retaliating against employees who complain, you are describing nothing short of God’s truth. Who, but the guilty would contest that? No one with any dignity, integrity, self respect.
